Dear Patent Writer or Patent Reviewer:
My name is Carlos de la Huerga and I’ve been involved in the patent process for over 25 years.
As you and I both know, manually reviewing a patent for quality is an arduous and expensive process.
But critical.
If you’re drafting a patent, you want to identify any problems prior to submission. And, if you’re involved in patent licensing or patent infringement, you want to make sure that no weakness goes unnoticed.
– with critical, overlooked details often causing a major weakening in protection. The Telaric patent examiner was developed to automate many aspects of this process to help ensure that your ideas are as well protected as they can be
My software assists with patent quality review
I was so overwhelmed by this process that a few years ago I developed some software to make my life a bit easier.
Although this software was useful from the beginning, over time – as I added features and functionality – it turned into a hugely powerful tool by doing two things:
- Automating many of my patent-review tasks – thus reducing the time I spent examining a patent for weaknesses.
- Performing sophisticated checks to identify errors that I may have otherwise missed through a manual review.
Basically it operates like a spelling and grammar checker - using advanced word-processing technology to identify errors – but with sophisticated checks that are specific to patents.
What I found was that I could examine a draft patent in just a few minutes for problems that might cripple the patent later. But I also realized that it could be used
by patent licensing and litigation attorneys to quickly and easily understand the weaknesses in issued patents that are the subject of a licensing negotiation or patent infringement case.
Once I completed the software, I found that using it resulted in six valuable benefits
For me, it:
- Reduced the time and effort needed to analyze patents for quality.
- Performed checks that were nearly impossible for me to do manually.
- Provided valuable insights into the construction of high-quality patents – due to the embedded expertise of some of our nation’s top intellectual property experts.
- Identified poorly constructed claims, inconsistencies and errors – all automatically.
- Ensured consistency of analysis.
- Served as a quality assurance tool for evaluating the work of others on my patent team.
No one would finalize an ordinary document without scanning it with a spelling or grammar checker. Likewise, I decided that no one should finalize the review of a patent without scanning it with my software – so I created a commercial product.
Useful in drafting a patent, as well with patent licensing or infringement
As you know, patents are enormously complex and expensive to get – but have substantial future value if drafted well.
Therefore, like any product of a business, patents deserve to be put through a solid quality assurance process before being released to ensure they are as strong as possible and able to withstand future scrutiny. And, if you’re a patent licensing or litigation attorney, you want to ensure that you’ve identified all weaknesses in a patent before finalizing a licensing agreement or infringement case.
In either case – before a patent is submitted or after it has been issued – my software can provide substantial value by automating many of the quality assurance checks that you are currently doing manually.
If you are drafting a new patent, don’t let errors go undiscovered until the patent is the subject of a licensing negotiation or patent infringement case – when multiple lawyers are reviewing every claim, word-by-word, in an attempt to find weaknesses.
And, if you are involved in a patent licensing or infringement, don’t risk missing weaknesses in a patent that could significant impact the outcome of your efforts.
Best Regards,
Carlos de la Huerga
